DIM X SOMATOLINE CONTEST RULES

(the " Rules")

1. Organizer

The company Dim France SAS, a simplified joint-stock company, registered with the Trade and Companies Register of Nanterre under the number 488 727 298, whose head office is located at 2 rue des Martinets, 92500 Rueil Malmaison, France (the "Organizer") is organizing from April 17, 2024, to April 29, 2024, inclusive, a contest requiring a purchase, "DIM x SOMATOLINE" (hereinafter referred to as the "Contest") in accordance with the terms described in these rules.

The Contest is accessible on the dim.fr website from 04/17/2024, 7:01 AM to 04/29/2024, 11:59 PM CEST (hereinafter referred to as the "Duration").

Participation in the Contest implies full acceptance of these rules (hereinafter referred to as the "Rules") in all its provisions, as well as of the applicable laws and regulations concerning contests without obligation to purchase and their enforcement by the Organizer.

2. Participation Conditions

The Contest is open to any adult natural person with full legal capacity on the date of participation (hereinafter the "Participant(s)"), residing in mainland France, including Corsica.

Employees of the Organizer or any of its subsidiaries, and anyone who has directly or indirectly participated in the conception, creation, or management of the Contest, as well as members of their immediate family, are not permitted to participate.

The Organizer reserves the right to request that Participants prove they meet the participation conditions.

If the winner is found not to meet the participation conditions, the Organizer reserves the right to award the prize to another Participant and/or request the return of the already awarded prize.

Any Participant who participates or attempts to participate in the Contest in violation of these Rules or in an unfair manner towards other Participants (including but not limited to interfering in the organization of the Contest, cheating, hacking, deceiving, or using any other unfair practice such as harassing, intimidating, or threatening other Participants, the Organizer, and/or one of its agents or representatives) may be excluded from the Contest.

3. Participation Period

The Contest is available in participating DIM stores from 04/17/2024, 7 AM to 04/29/2024, 11:59 PM CEST.

4. Participation Methods and Selection of Winner(s)

4.1 Selection of Winner(s)

This Contest takes place exclusively on www.dim.fr on the dates mentioned in Article 3 above.
The winners will be selected by a random draw.
Throughout the Duration, each day will result in a draw based on the orders placed the previous day.
The draw will be conducted under the supervision of Ms. Axelle DARPHEULLE, a member of the e-commerce team, and a member of the legal team.
Participation in the Contest is strictly personal and nominative.
Only one participation per person – same name, same first name, same email address – is allowed during the entire Contest period.
 
If a participant wishes to withdraw their participation, they can contact DIM through its Facebook or Instagram accounts at https://instagram.com/dim?igshid=YmMyMTA2M2Y= or via DIM customer service at serviceclient@dim.fr.
The Organizer reserves the right to refuse participation or eligibility of a participant not complying with the instructions and conditions set out in the Rules, particularly in the above-mentioned articles.
The participant is fully responsible for the data and all content published during their participation in the Contest and must ensure that it is accurate and does not infringe on any third-party rights. Any participation containing errors, fraud, or illegalities will not be considered and will be deemed invalid.

 

4.2 Disqualification / Participation Exclusion

Participants authorize the Organizer to verify their identity, age, domicile, and phone number within the framework of the Contest, although the Organizer is not obliged to systematically verify all participation. Any participation that does not comply with the Rules, is incomplete, false, or contains incorrect contact information will be deemed invalid.

4.3 Winner Notification

The winner will be informed of their selection by the Organizer via email no later than 7 days after placing their order on the dim.fr website.

The winner must confirm in writing their acceptance of the prize within 5 days of receiving the email notification.

The Organizer cannot be held responsible if the winner's information, including their email address, is falsified or incorrect.

Any winner who does not respond within 5 days of the email notification will be considered as having forfeited their prize, and the prize will be awarded to another participant selected by draw.

The winner agrees to submit any documents required by the Organizer to process their prize.

5. Prizes

5.1 Number of Winners
The Game results in one (1) winner per day during the period indicated in Article 1, i.e., 13 (13) winners throughout the Game Duration.
5.2 Prize
The Organizer allows the winner to win a set of Somatoline products worth €125 (commercial value), presented to participants under the name Complete Toning Routine, consisting of 4 products:

5.3 Prize Distribution

The winner must share their personal details, including their postal address, with the Organizing Company via email. By doing so, the winner consents to share their data with the Somatoline brand through the Organizing Company. The Organizing Company will send the prize products by post within 30 days of receiving the winner's confirmation.

6. Rules

    Participation in the Game implies full and unconditional acceptance of the Rules by the Participants.

    The Organizer reserves the right to extend, shorten, modify, or cancel the Game at any time, particularly in cases of force majeure, without any compensation being claimed by the Participants.

    Any modification will be the subject of an amendment, published on the Organizer's website at www.dim.fr and communicated in participating stores.

    No requests or claims regarding the application or interpretation of the Rules will be answered by telephone. Any disputes or claims relating to the Game and/or the methods for designating the winner(s) must be submitted by Registered Letter with Acknowledgment of Receipt to the address indicated below, no later than thirty (30) days following the end of the Game.

    7. Personal Data

    The Organizer will collect and process the personal data of Participants as necessary for conducting the Game, particularly for selecting the winner and delivering the prize, in accordance with its Personal Data Policy accessible here: https://www.dim.fr/protection-des-donnees/privacypolicy.html.

    The personal data collected about Participants includes: names, first names, email addresses, mobile phone numbers, and postal addresses.

    The data collected as part of this offer is solely intended for processing participation in the Game.

    This processing is based on the Participant's consent, which can be withdrawn at any time.

    However, without this data processing, the Participant's participation cannot be considered.

    The data collected is intended solely for use by the following recipients: Dim France SAS, acting as data controller.

    Participants have the right, under the conditions provided by regulations, to access, delete, and transfer their data, and to object to or limit its processing.

    Participants also have the right to define instructions regarding the fate of their data after their death, under the conditions defined in Article 40.1 of the French Data Protection Act.

    Finally, Participants have the right to file a complaint with the relevant supervisory authority (CNIL).

    The person concerned by the rights request must clearly indicate their first and last names and provide a copy of an identity document or participation proof.

    You also have the right to file a complaint with the CNIL and the right to define post-mortem data directives by postal mail addressed to: CNIL – Complaints Service – 3 Place de Fontenoy – TSA 80715 – 75334 PARIS CEDEX 07.

    Participants' personal data will be kept for the time necessary to organize the Game and distribute the Prize, and will be deleted within six (6) months after the end of the Game.

    8. Force Majeure

    The Organizer shall not incur any liability if, in the event of force majeure, it is forced to cancel the Game, shorten, extend, postpone, suspend, or modify its conditions.

    The Organizer reserves the right to extend the participation period in all cases.

    9. Liability

    The Organizing Company may not be held liable if, in the event of force majeure or events beyond its control, it is forced to modify, shorten, or cancel the present offer, and no compensation may be claimed by the participants.

    Participation implies knowledge and acceptance of the characteristics, limits, and risks of the Internet, particularly with regard to technical performance, response times for consulting, querying, or transferring information, the risks of interruption, and, more generally, the inherent risks of any connection and transmission via the Internet, the absence of protection of certain data against possible misuse, and the risks of contamination by any viruses circulating on the network. The Organizer declines all responsibility in the event of improper use or incident related to the use of the computer, Internet access, maintenance, or malfunction of the servers, the telephone line, or any other technical connection, and the sending of forms to an incorrect or incomplete address.

    10. Applicable Law and Jurisdiction

    These rules are subject to French law. For any dispute, the Nanterre courts will have exclusive jurisdiction.
